American law enforcement is in crisis, yet every effort intended to advance meaningful reform seems to wither and die. Perhaps the effort has been misplaced? Whereas the emphasis remains on the law enforcement profession as a whole, a twin movement must be launched to raise the awareness of the American people; in particular, about their Constitutional rights and the need to promote those rights during police encounters.
American law enforcement has lost its way, particularly after 9/11, and its trajectory is headed in the wrong direction. Some notable observers have concluded that the police may have already reached the point of no return; whereby reformation of long-standing police practices detrimental to community relations is no longer feasible. Unless something changes very soon, the United States of America will almost certainly become a quasi-police state. In some ways, it already has. This book is my way, my ONLY way, of fighting back against the looming tyranny. WHAT IS C + R + C?
C + R + C = Lawful Terry Stop is a valuable tool to help officers make lawful stops and detentions by articulating reasonable suspicion, according to the “totality of the circumstances.”
C = Crime: Officers must articulate a specific crime that has occurred, is occurring, or is about to occur.
R = Reliability: The source of information must be reliable. Officers are automatically deemed reliable and, in addition, can pass along reasonable suspicion to another officer under the “Collective Knowledge Doctrine.” Victims and witnesses are considered reliable under the “Citizen Informant Doctrine” in one of two ways: (1) the alleged crime is reported directly to 9-1-1, regardless if the report is filed anonymously; and (2) the alleged crime is reported by a means other than 9-1-1, but the reporting party can still be identified.
C = Corroboration: Stops and detentions are authorized in one of two ways: (1) if the officer can corroborate the description of the suspect, or (2) if the officer can corroborate the description of the suspect vehicle.
The following TWELVE scenarios will help demonstrate the proper way to apply C + R + C:
#1. You receive a 9-1-1 report of a reckless driver traveling eastbound on Highway 14 near mile marker 424. The caller reports that a small, muddy-green car with an unknown license plate is swerving all over the road. The plate is unreadable because of the mud, but they report that the driver is an older white female. The caller tells you that the green car turned south onto 471st Avenue and almost went into the ditch. You drive north on 471st Avenue to locate the small green car. Still driving northbound, you meet a clean, full-size green car with license plate 809-DRT driven by a Hispanic male. There are several others in the vehicle. Would you perform a Terry Stop based on reasonable suspicion to investigate lane driving and possible DUI?
#2. The caller is driving east on I-90 near mile marker 341. They report that a lone white male is driving a blue Nissan Altima, license plate 509-636. The caller states that the vehicle is all over the road, nearly going into the ditch twice. The caller does not want to sign a complaint, but they provide their name and contact number. You enter the interstate at mile marker 346 and spot a blue Nissan with license plate 509-636, driven by a lone white male. You follow the vehicle but see nothing illegal. Would you perform a Terry Stop based on reasonable suspicion to investigate reckless driving and possible DUI?
#3. The floor manager from Dakota-Wilderness Sporting Goods is on the phone. He just attempted to detain a shoplifter suspected of stealing a GPS unit. According to the manager, the suspect ran from the store and got into an older model, gray Ford two-door pickup, partial license plate SL7. The suspect is a short white male in his mid-thirties, wearing a black t-shirt and jeans. About ten blocks from the store, you observe an older model, two-door gray Ford pickup traveling south on Normandy Avenue. The license plate is SL7-7B2. Driver is a lone white male in his mid-thirties, wearing a black t-shirt. Would you perform a Terry Stop based on reasonable suspicion to investigate the shoplifting complaint?
#4. You are on the non-emergency line with a caller who says they are following a drunk driver away from the notorious Saturn Bar. The caller states that the driver was stumbling to her vehicle and almost struck another car when she drove away. The vehicle is a silver Dodge Caravan driven by an older white female. The license plate number of the van is WEK-908. The caller refuses to provide their name or contact number, but said the suspect is traveling eastbound on Highway 18. No further information is available. You meet a silver Dodge Caravan with license plate WEK-908, approximately twelve miles from the Saturn Bar on Highway 18. The driver is an older white female. You do not observe any traffic infractions. Would you perform a Terry Stop based on reasonable suspicion to investigate the careless driving and possible DUI complaint?
#5. Pat McKnight, who farms three miles west of Mt. Vernon, called to report that two men in a red Chevrolet four-door pickup had stopped on the road near his farmhouse. The front seat passenger stuck a shotgun out the window and shot a pheasant standing in the ditch, only 100 feet from the house. The passenger got out, grabbed the pheasant, and hopped back into the front seat. The pickup was headed west on 210th Street, near the intersection of 432nd Avenue. Pat could not read the license plate but said it had a distinctive red border around it. Also, the tailgate was missing and two black lab dogs were in the back. The shooter was wearing a bright orange cap. Pat does not want to sign a complaint but thought you should know about it. Fifteen minutes later, you meet a red Chevrolet four-door pickup with a red-bordered license plate near 203rd Street and 432nd Avenue. The passenger is wearing a bright orange cap. You notice the tailgate is missing and two black lab dogs are in the back. Would you perform a Terry Stop based on reasonable suspicion to investigate the possible hunting violation?
#6. You are responding to a report of an assault that occurred at 1423 West Valley Avenue. A boyfriend had allegedly beaten up his girlfriend and fled the scene. The witness who reported the incident lives next door at 1425 West Valley Avenue. The neighbor/witness said the boyfriend left in a maroon Dodge Durango, license plate 909-BBR, traveling eastbound. You meet a maroon Dodge Durango traveling southbound on an interstate service road approximately eight miles from the scene. The plate on the Durango is 909-BBR. Would you perform a Terry Stop based on reasonable suspicion to investigate whether the driver was involved in the alleged assault?
#7. You are on the phone with a caller who said a hit-and-run accident had occurred at the intersection of West 16th Street and North Main Avenue. The caller said she was rear-ended by the driver of a white pickup, possibly a Dodge. The driver turned around and sped away southbound on North Main Avenue, too quick to get a license plate number. The driver was a lone African-American female. The caller said the pickup has front-end damage because of the accident. The caller refused medical attention, but said she would remain at the scene until an officer arrived. You respond and meet a white Ford pickup traveling south on North Main Avenue, near the intersection of West 6th Street. Driver is an African-American female. A white male passenger is with her. You notice the pickup has considerable front-end damage and leaks fluid. Would you perform a Terry Stop based on reasonable suspicion to investigate whether the driver was involved in the hit-and-run accident?
#8. A homeowner is on the phone and reports that someone is kicking the side door and demanding entry. The address is 344 Western Ridge Road. The homeowner has a gun and said he would shoot the suspect if they break in. The caller pauses, then says the suspect left and is running eastbound on Western Ridge Road. The suspect is a white male wearing blue jeans and a black and white sweatshirt. Four blocks from the scene, you observe a lone white male walking on Western Ridge Road. He spots your cruiser, turns quickly, and begins walking down 3rd Avenue. The suspect is wearing a black and white hooded sweatshirt and blue jeans. Would you perform a Terry Stop based on reasonable suspicion to investigate the suspect’s involvement with the attempted break-in?
#9. The caller is on the line with 9-1-1 claiming that a blue Toyota pickup, license plate M8M-956, jumped the curb on North Tyler Street and drove west on the sidewalk for half a block. The caller said the vehicle turned north on Division Drive and sped away. The caller refuses to identify themselves. You drive to the address of the registered owner and wait. A blue Toyota pickup, license plate M8M-956, soon pulls into the driveway. You observe no violations or problems of any kind. As you approach the pickup on foot, the driver gets out and walks toward the home’s front door. Would you perform a Terry Stop based on reasonable suspicion to investigate whether the driver was involved with the unsafe driving report?
#10. Steven Kirkpatrick from Whitewood is on the line. He said that two hunters riding in an orange-colored International Scout pickup stopped on the road near his home and shot a deer standing in the old cedar shelter belt. Steven estimated that the poachers were approximately 30-40 yards from his house when the driver shot the deer from the vehicle. Steven left his driveway intending to confront the men when the driver took off unexpectedly at a high rate of speed, headed north on 197th Avenue. Steven is upset and wants to sign a complaint. The license plate was mud-covered, but Steven claimed the vehicle is unmistakable. Twelve miles north of the scene, you spot an orange International Scout pickup turning west from 197th Street onto the Avance Road. There are two men inside. Would you perform a Terry Stop based on reasonable suspicion to investigate whether the men were involved in the deer poaching incident?
#11. It is 2:30 in the morning, and you are on foot patrol in the downtown area of South Main Street. From around the corner, you hear loud laughter and someone screaming obscenities, quickly followed by sounds of smashing glass and crunching metal. You turn the corner in time to see two men on the opposite sidewalk walking away at a brisk pace. You notice that a nearby car has a smashed windshield and caved roof. There is no one else in the area. Would you perform a Terry Stop based on reasonable...
